1) Contact Information All information on file pertaining to your account should be accurate. It is your responsibility to provide us with an email address that fits the following criteria: - Active, checked and avilable 24/7. - Not at a free host, which could potentially cause problems when we need to contact you. It is your responsibility to ensure the email address on file is up to date at all times. All information is kept private and is not distributed or resold. 2) Account Setup Account Creation Any account created in our systems is activated only upon successful payment of balances due. Account Transfers If your site is at another host, our technical agents will assist you while you move your site to our servers. This service is offered as common courtesy only and is not subject to any guarantees. Other hosts can be different and transferring a site might take time and may not even be possible. 3) Website Content All of OkTeck.com services are to be used lawfully and are subject to laws under the province of Quebec and Canada. By agreeing to our terms of service, you cannot hold OkTeck.com at fault claims resulting from the use of our services. The following list underlines examples of things you cannot do while using our services. - Copyright/Trademark infringement regardless of type: music, books, graphical, or other. - Fake sales sites. - IRC bots/bouncers, proxy mailers, warez of any form, HYIP and FOREX trading and related sites, Phishing (Bank, eBay, Paypal, etc), MUD/MOOs, Game Servers (Quake, Battlefield 1942, etc). - Pornographic material: child, animal and anything we deem generally unacceptable. We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene or threatening is prohibited and may be removed from our servers without notice. We will most likely send you an email before we do anything, however, failure to respond to email from our Abuse Tecks within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via our online contact methods and will have a response within 48 hours. If needed, we will contact the appropriate law enforcement agencies to help take care of any matter reulting from your abusive behavior. 4) Security Scripts/Web Applications It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation methods. WE RUN SuPHP (PHP-SUEXEC) AND CGI-SUEXEC! If one of your scripts installations asks to set permissions to 777 for anything, you don't need to. Please, set all permissions to a maximum of 755 when you're using CGI or PHP. Since scripts run under the usernames, you don't need permission 777. You are ultimately held responsible for any abuse caused under your account, regardless of a direct or indirect violation. Please update your scripts whenever you get a chance as bugs are found daily. Passwords We may need to advise you if a weak password is discovered. Usually, our abuse agents advise you and a reply and action is required withing 48 hours. Failure to change the password might result in an account suspension or an on-the-fly password change without notice. Please set passwords that use the following guidelines: - Not words that are directly related to you. - Mixed characters: alpha (letters a to z), capital and lowercase (asSDFf), numeric (0 to 9) and alternate characters (%!#@). - At least 8 characters long. 5) Spam Policy Simple, zero tolerance. UBE/UCE Our zero tolerance covers all forms of UCE (Unsolicited Commercial Email) and UBE (Unsolicited Bulk email). The following systems are unacceptable: - FFA (Free For All) - Safelist Scripts - ARP3 If you are using the above or any variants of the above, your account is subject to suspension without notice. The names provided above are purely for examples of scripts that could infringe by UBE/UCE. Spamvertisement If your site URL was linked in an abusive email, then you are most likely affiliate based. Gaining from involvement in SPAM is treated the same as direct spam. We do not tolerate it, period. If we get any reports involving you, from any entity, you may get suspended without notice. ROKSO list Any organization or entity listed in the ROKSO may not be hosted on our servers. If you're part of ROKSO, or are a listed variant, you will be terminated and/or suspended. IP Blacklisting Events Any accounts which result in our IPs becoming blacklisted at any SBL will be immediately suspended and/or terminated. 6) Payment of Services Payment Information You agree to supply us with accurate payment information for the services provided by OkTeck.com. Cancellations and End of Services We reserve rights to change the monthly payment amount and any other charges at anytime. Unless you notify us through our helpdesk, your services will be billed on a recurring basis. Cancellations must be done in writing via the Helpdesk located in your members area here: http://www.okteck.com/login.php Refunds You may cancel at any time via our Helpdesk. There are no refunds on or domain name purchases. Refund requests after 30 days will be refunded on a prorated basis of any unused time. Duplicate Payments When and if you were billed more than once when the recurring period occured, then please get in touch with us through your Helpdesk in the members area. 5) Backups and Data Loss Your use of the service is at your sole risk. OkTeck.com is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers. 7) Account Usage Backups We are not responsible for data loss so please make backups. You are responsible for all email, files and data held within your account. You are required to generate and download your backups as often as you can to insure your activities are current. We do carry daily/weekly/monthly backups however, and they are fresh for 30 days. If we lose all data, you are still responsible for having a recent backup stored locally. Account Usage Server Resources You cannot use resources that we deem too process intensive. Our technical agents will usually get in touch with you and let you know what's going on. You cannot connct to IRC or use any remote management services that may take up alot of server resources. Again you will be advised of any problems with your scripts/programs. Bandwidth We reserve the right to suspend your account if it is over your monthly bandwidth limit. We may require you to upgrade if you are over bandwidth. When your billing recurs, we do not carry left-over bandwitdh to the following months. Disk Quota We are not responsible for your site being over disk space quota. It is your responsibility to advise our Helpdesk of your issues and we can assist you in finding the solution to your problem. We may require that you upgrade your account type to solve these issues. 8) Changes Your payments Your payment prices will never change unless you upgrade your package. Our listed pricing and resource limits We reserve the right to change prices listed on okteck.com, and the right to increase the amount of resources given to any plan at any time. In the case of an account change, you may upgrade to get access to the changed level resource limitations. Your account will not inherit any positive changes to our resource packages unless an upgrade is made. 9) Indemnification You agree that you will indemnify, save and hold OkTeck.com harmless from any and all demands, liabilities, losses, costs and claims. You agree to indemnify and hold OkTeck.com harmless against liabilities arising out of; (1) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (2) any injury to a person or property caused by any products sold or otherwise distributed in connection with OkTeck.com ; and (3) copyright infringement. 10) Disclaimer OkTeck.com won't be held responsible for any damages yourself or your business may suffer. We make no warranties of any kind implied for services we provide. OkTeck.com disclaims any warranty or merchantability or fitness for any particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by OkTeck and/or its employees. 11) Disclosure to law enforcement OkTeck.com may disclose any subscriber information to law enforcement agencies without notification. We will co-operate with any law enforcement agency. 12) Changes to our Terms of Service (TOS) We reserve the right to revise our policies at any time without notice. |
